Assault

Under Ohio Revised Code Section 2903.13, no person shall knowingly cause or attempt to cause physical harm to another or another’s unborn, nor shall a person recklessly cause serious physical harm to another or another’s unborn.
There are varying degrees of severity accompanying an assault charge depending on the circumstances of the alleged crime, as well as whom the crime was committed against.

Simple or Common Assault:

  • Knowingly causing or attempting to cause physical to another or another’s unborn.
  • Recklessly causing serious physical harm to another or another’s unborn.
  • Simple or common assault is considered a misdemeanor of the first degree and may result in up to 6 months in prison and/or up to $1,000 in fines or restitution.

Negligent Assault:

  • Negligent assault is the act of causing physical harm to another through the negligent use of a deadly weapon.
  • Negligent assault is typically considered a misdemeanor of the third degree and may result in up to 60 days of jail time and/or up to $500 in fines or restitution.

Aggravated Assault:

  • Causing serious harm to another or another’s unborn child
  • Causing or attempting to cause harm through the use of a deadly weapon and does this while “under the influence of sudden passion or in a sudden fit of rage.”
  • Aggravated assault is considered a felony of the fourth degree and may result in prison time ranging from 18 months to 6 years and/or up to $5,000 in fines or restitution.

Felony Assault:

  • Causing serious harm to another or another’s unborn
  • Causing or attempting to cause harm through the use of a deadly weapon.
  • Felony assault is considered a felony of the second degree and may result in prison time ranging from 2 years to 8 years and/or up to $20,000 in fines and restitution.
